Terms of Service

1. The service
Nightjar provides a WireGuard-based virtual private network. Subject to these terms, we grant you a personal, non-transferable right to use the service on up to five devices.
2. Your account
You are responsible for keeping your password secure and for activity on your account. Accounts are for one person. Sharing credentials beyond your own devices is not permitted and may result in suspension.
3. Acceptable use
You may not use Nightjar to:
- Send unsolicited bulk email. Outbound SMTP is blocked at our servers.
- Attack, scan, or attempt to gain unauthorised access to any system.
- Distribute malware, or take part in a denial-of-service attack.
- Distribute material that sexually exploits children.
- Do anything unlawful in the jurisdiction you are connecting from or to.
We may suspend an account we reasonably believe is being used for these purposes. Because we keep no traffic logs, such action normally follows an abuse report about one of our servers rather than any inspection of your activity.
4. Trial and billing
New accounts include a seven-day free trial with no card required. After the trial, access continues only with an active paid subscription. Subscriptions renew automatically at the end of each period until cancelled. Prices are in US dollars and shown before you pay.
5. Cancellation
You may cancel at any time from your account. Access continues until the end of the period you have already paid for. See our refund policy.
6. Availability
We aim for continuous availability but do not guarantee it. Servers may be unavailable for maintenance, network failure, or action by our hosting providers. We do not guarantee any particular connection speed, nor access to any specific third-party service, including streaming platforms, which actively block VPN traffic.
7. Liability
The service is provided as is. To the fullest extent permitted by law, our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose.
8. Changes and termination
We may update these terms and will notify active subscribers by email before material changes take effect. We may terminate an account for breach of section 3, and will refund any unused prepaid period unless the breach involved illegal activity.
9. Governing law
These terms are governed by the laws of the United Arab Emirates, and the courts of Dubai have exclusive jurisdiction.
